Terms & Conditions
These terms apply to the GemsMountain website and to quotations, samples and wholesale orders unless different terms are confirmed in writing.
Effective date: August 3, 2026. The quotation, product specification and order confirmation form part of the agreement.
1. Website and Business Scope
GemsMountain supplies crystal, gemstone and packaging products, primarily for wholesale customers. Website information is for reference and is not a binding offer.
2. Quotations and Order Acceptance
An order is accepted when we issue written confirmation and any required deposit or payment has cleared. We may request changes where materials, capacity, compliance or shipping arrangements are unavailable.
3. Natural Materials and Variation
Natural products may vary in colour, pattern, transparency, inclusion, shape, weight and dimensions. Images and samples are representative. Treatments, composites or man-made materials will be described where applicable to the confirmed specification.
4. Pricing, Taxes and Payment
Prices may change before acceptance due to material, labour, packaging, exchange-rate or freight changes. Bank fees, import duties, taxes and destination charges are the buyer’s responsibility unless stated otherwise.
5. Samples, Artwork and Custom Packaging
Sample, tooling, printing and courier fees may apply. The buyer must check artwork, names, barcodes, dimensions, colours and regulatory text before approval. Production based on approved artwork or samples is authorised by the buyer.
6. Lead Times
Lead times are estimates beginning after final specifications, artwork and payment requirements are complete. Natural material availability, custom work, holidays, inspections and logistics may affect timing.
7. Shipping and Delivery
Shipping method, cost and responsibility are stated in the quotation. Carrier delivery dates are estimates. The buyer must provide complete consignee and customs information and cooperate with import requirements.
8. Inspection, Claims and Returns
Inspect goods promptly and retain packaging, labels, photos and videos for any visible damage, shortage or specification issue. Custom, branded, opened or used goods may not be returnable unless defective or agreed in writing.
9. Intellectual Property
Website content and original materials may not be commercially reused without permission. Buyers confirm that artwork, logos and other materials they supply may legally be used for the requested order.
10. Liability and Force Majeure
To the extent permitted by law, GemsMountain is not liable for indirect loss, lost profit, misuse, natural variation, carrier delay or events outside reasonable control. Direct liability will not exceed the amount paid for affected goods unless law requires otherwise.
